It has to do with the "charitable" organization. The exact figure of 5%
isn't in stone, more of it shows that the company is donating money to
charity, and thus a charitble organization. One of the qualifying factors
for a corporation to receive the tax benefits of a 501(c) is that they are a
charitable organizations (others are religious, education, etc). I.e. it's a
way to stay "safe"...
